What is copyright? Copyright, a form of intellectual property law, protects original works of authorship including literary, dramatic, musical, and artistic works…  Do I have to register with your office to be protected?  No. In general, registration is voluntary. Copyright exists from the moment the work is created. You will have to register, however, if you wish to bring a lawsuit for infringement of a U.S. work.”

 

Moreover, merely selling a painting (or artwork) is NOT selling the “copyright” to the work:  quoting the Copyright Office Website again:  Mere ownership of a book, manuscript, painting, or any other copy or phonorecord does not give the possessor the copyright. The law provides that transfer of ownership of any material object that embodies a protected work does not of itself convey any rights in the copyright. In other words, the artist can sell the copyright to an artwork separately, or retain the copyright himself and continue to sell reproductions even after he has sold the original painting or work of art.   

 

As printers, we have no rights to your artworks.  In fact, we can only print your copyrighted material with your written permission, which is easily accomplished by signing the “copyright ownership affidavit” statement on our Personal/Contact Information form when submitting your images to us the first time.  A sample of that has been posted directly below.

We reserve the right to demand proof of copyright privileges in questionable cases & to out right refuse any images for which a convincing case for copyright ownership or privilege cannot be sufficiently established.

COPYRIGHT OWNERSHIP AFFIDAVIT
My signature below indicates that the art work I am submitting to Color Simulation Service is:  1) my own original work, 2) I own the copyright to someone else's work by virtue of inheritance or outright purchase of the copyrights (mere ownership of a painting does not give you copyrights), 3) I have written permission of the original copyright holder to have reproductions made.  I authorize CSS, Inc. to proof and print orders from said images.  I assume any and all legal responsibility  and financial responsibility for any and all issues related to, and arising from questions of violation(s) of  or infringements on copyright(s) and privileges of any and all copyright holders.   CSS, Inc reserves the right to:  1) demand proof of copyright privileges in questionable cases,  2) to refuse any images for which a convincing case for copyright ownership or privilege cannot be sufficiently established.

Handling of Your Digital Image Files:   The computers in which we store digital files of your paintings are not on-line, making them immune from hacking or pirating. We are very serious about fiercely protecting your copyrights to your images.
      Although calamitous natural or man-made events can cause the loss of data, we routinely create back-up files of all work--on multiple drives, in multiple locations--to lessen the risk of such occurrences. To date we’ve never experienced any type of issue in this area.*
      As long as you are an active client, your work is kept indefinitely. If your account is inactive for 12 months, your work is placed onto an archive hard drive. Once the art is there, we do not guarantee that we will retain it indefinitely. Older files are periodically removed when storage space is needed for newer files.

     *While all safeguards are put into place to keep your active art image files intact, we will not be held responsible should--in the unlikely event--your work be lost.
